We the undersigned, Fabrice Brunetti, Harbour Master, located at “LE PORT / Port Réunion”, sworn in pursuant to the law,
Having regard to French law No. 2013-431 of 28 May 2013 on various provisions in matters of transport infrastructure and services;
Having regard to Decree 2016-1893 of 28 December 2016 pertaining to the provisions of the French Transport Code;
Having regard to the French General Code of Public Property, Article L2132-3;
Having regard to the French Transport Code, Articles L5141-1 to L5141-2-1; L5335-1 to L5335-5 and R5141-1 to R5141-8;
Having regard to the official report drawn up by the Harbour Master of Grand Port Maritime de La Réunion (GPMDLR) dated 28 June 2019 pertaining to the state of abandonment of the vessel LADY SUZANNE (CHRIS CRAFT brand) located within the administrative limits of GPMDLR.
WHEREAS
The illegal occupation of maritime public property resulting from the vessel LADY SUZANNE being docked within the administrative limits of Grand Port Maritime de la Réunion;
This prolonged obstruction is impeding performance of port activities (Art. L5141-1 of the French Transport Code);
The vessel is in a state of abandonment (Art. L5142-2 of the French Transport Code), characterised by the degree of deterioration and lack of regular maintenance;
The absence of a vessel identification mark and the impossibility of establishing ownership thereof;
The owner to end the state of abandonment of the vessel within two months from the date of publication of this notification on the website of Grand Port Maritime de La Réunion;
If no action is taken after this period, a procedure to forfeit ownership of the vessel will be initiated.
In witness whereof, we have hereby served this formal notification in Port Réunion on 2 January two thousand and twenty.
